Holiday 2022: a summer overshadowed by flight cancellations and delays

Since the start of the summer a large number of flights have been delayed or cancelled as a result of shortages or strikes affecting the various airlines’ workforces. Unfortunately, there is no light at the end of the tunnel yet because new strikes, cancellations and delays risk jeopardising your travel plans.

Fortunately, travellers in the European Union enjoy certain guaranteed rights.

Rebooking or refund

Has your flight been cancelled or delayed for more than 5 hours? If so, you have the following two options at your disposal:

  • rebooking free of charge
  • a refund of the cost of your ticket

Have you opted for an alternative flight? If so, you are entitled to meals and refreshments proportionate to the waiting time, two free telephone calls, e-mails or fax messages and if necessary, an overnight stay in a hotel, including transport there and back.

Compensation

Irrespective of whether you have chosen to rebook or get a refund, you are entitled to fixed compensation if you were notified of the cancellation less than two weeks prior to departure. The same applies if you arrive at your destination with a delay in excess of 3 hours.

An announced strike by airline staff is not considered force majeure

If a flight is delayed or cancelled due to force majeure, e.g. weather conditions or a strike outside the scope of the airline, the latter shall not be obliged to pay the compensation.

Has your flight been delayed or cancelled due to a previously announced strike by airline staff? If so, the airline has time to impose appropriate measures to minimise inconvenience to its passengers. This means that the airline cannot invoke force majeure and is obliged to compensate any affected passengers.
